Democratic Memory Law 20/2022 or Grandchildren’s Law

In Spain, the Law of Democratic Memory 20/2022, known as the Grandchildren’s Law, recognizes the right to opt for Spanish nationality to foreigners who apply before October 21, 2025 and who meet the following requirements:

  • Those born outside Spain of a father, mother, grandfather or grandmother of Spanish origin who, because they had to go into exile, had lost or renounced their Spanish nationality.
  • Sons and daughters born outside Spain to Spanish women who lost their nationality because they married foreigners before the Spanish Constitution came into force.
  • The adult sons and daughters of Spanish nationals whose nationality of origin was recognized by virtue of the right of option.

To be eligible for Spanish dual citizenship by descent, applicants must either:

  • have a Spanish mother or father by birth.
  • have parents who were both born in Spain.
  • have one grandparent or great-grandparent that was born in Spain; or
  • be adopted by a Spanish citizen before reaching the age of 18.
Steps towards proving ancestry and obtaining citizenship

The first step is to have tangible proof of the immigrant ancestor’s nationality through their birth or baptismal certificate.

Once this document has been obtained, the family relationship must be proven by providing the necessary documentation of all the intermediate generations and that of the applicant himself/herself, in the required format.

It is also essential to secure a consular appointment, but we recommend having all documentation ready beforehand.
